COPYRIGHT-PROTECTED WORKS IN ARTIFICIAL INTELLIGENCE TRAINING: ETHICAL AND LEGAL CONSIDERATIONS

Abstract
This article analyzes the legal legitimacy of the use of copyrighted works in the training of generative AI systems within the framework of Ecuadorian law. Using a qualitative, dogmatic, and comparative methodology, the study examines the regulatory gaps in national legislation regarding the use of protected content in automated processes, particularly in relation to the concepts of fair use, data mining, and algorithmic reproduction. It also compares international regulatory models, such as those in Europe and the United States, as well as relevant doctrine and current case law. Furthermore, the axiological foundations that underpin intellectual property in Ecuador are explored, highlighting principles such as the dignity of the author, the social function of creation, equity, and informed consent. The study concludes that the absence of specific regulation on generative AI weakens legal certainty and exposes authors to financial and moral vulnerabilities.
