Resumen

El presente artículo analiza el derecho al trabajo desde una perspectiva de género, enfocándose en las manifestaciones de violencia de género y discriminación en el ámbito laboral ecuatoriano. A través de una metodología cualitativa con diseño de casos tipo, se examinaron los relatos de diez mujeres trabajadoras y las valoraciones de personas expertas en el tema, evidenciándose cómo la violencia estructural y las prácticas discriminatorias afectan directamente el ejercicio efectivo de este derecho fundamental. Se emplearon técnicas como el análisis de documentos, entrevistas, registros materiales, grupos de enfoque y encuestas estructuradas, combinando métodos analítico-sintético, inductivo-deductivo y análisis documental. Aunque la Constitución ecuatoriana garantiza la igualdad y prohíbe la discriminación, los hallazgos revelan una distancia significativa entre el marco legal y las condiciones reales del mundo laboral. La informalidad, la debilidad institucional, la precariedad y la naturalización social de la violencia emergen como factores que generan impactos negativos en la salud emocional, la productividad y el acceso a mecanismos de denuncia efectivos. El estudio demuestra que la normativa, por sí sola, resulta insuficiente si no está acompañada de voluntad política, seguimiento institucional y procesos educativos en igualdad. Desde una mirada crítica y reflexiva, se propone la articulación coherente entre legislación, políticas públicas y condiciones laborales concretas, con el objetivo de garantizar el derecho al trabajo en contextos libres de violencia y discriminación por razón de género. De esta forma, se refuerza la necesidad de avanzar hacia relaciones laborales justas, inclusivas y transformadoras, que reconozcan y atiendan las desigualdades estructurales que enfrentan las mujeres en el entorno laboral ecuatoriano.

Abstract

This article analyzes the right to work from a gender perspective, focusing on manifestations of gender-based violence and discrimination in the Ecuadorian labor context. Using a qualitative methodology with a case-type design, the study examined the narratives of ten women workers and the assessments of subject-matter experts, revealing how structural violence and discriminatory practices directly undermine the effective exercise of this fundamental right. Techniques such as document analysis, interviews, material records, focus groups, and structured surveys were employed, combining analytical-synthetic, inductive-deductive, and documentary analysis methods. Although the Ecuadorian Constitution guarantees equality and prohibits discrimination, the findings expose a significant gap between the legal framework and the actual conditions of working life. Informality, weak institutional structures, labor precariousness, and the social normalization of gender-based violence emerge as factors that negatively affect emotional health, productivity, and access to effective reporting mechanisms. The study shows that legal provisions alone are insufficient without political will, institutional follow-up, and educational processes in gender equality. From a critical and reflective approach, the article proposes the coherent articulation of legislation, public policy, and concrete labor conditions to ensure the right to work in environments free from violence and gender discrimination. This reinforces the need to move toward fair, inclusive, and transformative labor relations that recognize and address the structural inequalities faced by women in the Ecuadorian workplace.
